About these terms

These Terms of Use apply to the pq Solution website, NFC product activation, destination management, and related digital services operated by PALM N PIXEL S.L. Contact: hi@p-q.es. Full company details are available in the Legal Notice.

Enquiries and organiser orders

The website does not provide automatic online purchasing. A submitted enquiry is a request for review only. It does not create an order, guarantee feasibility, reserve stock, or take payment. An organiser order exists only after PALM N PIXEL S.L. confirms it in writing under an accepted quotation or separate agreement.

Organisers are responsible for the accuracy of supplied event information and for having permission to use every name, logo, image, trademark, or design they provide. Product specifications, quantities, delivery dates, pricing, taxes, shipping, approval steps, and payment terms are confirmed in the quotation or agreement.

Organiser responsibilities and warranties

Each organiser represents that it is authorised to place the enquiry or order and that all information and materials it supplies are accurate, lawful, non-infringing, and suitable for the requested use. The organiser is solely responsible for obtaining all permissions, licences, releases, and approvals required for event names, logos, photographs, artwork, trademarks, personal information, promotions, and destination content.

The organiser is responsible for reviewing and approving proofs, quantities, product information, destinations, and delivery details before production or release. PALM N PIXEL S.L. is not responsible for errors contained in organiser-approved materials or instructions, except to the extent the error was introduced by PALM N PIXEL S.L.

Where the organiser acts in the course of a business or profession, it will reimburse PALM N PIXEL S.L. for reasonable losses, claims, and costs arising directly from materials, instructions, promotions, or destinations supplied or controlled by the organiser that infringe law or third-party rights. This does not apply to the extent a claim was caused by PALM N PIXEL S.L., and it does not reduce any mandatory rights.

Age declaration

The digital activation and management service is intended for people aged 18 or older. A person activates the service by declaring that they are at least 18. We do not request identity documents or a date of birth for this purpose.

Activation and ownership

• Each NFC product has a unique permanent code.
• The first successful activation associates the NFC product with the email address confirmed through the activation link.
• The owner is responsible for maintaining access to that email account and for ensuring that the chosen destination is accurate and lawful.
• We may require reasonable evidence before changing ownership or assisting with a lost email account.
• NFC codes remain permanently reserved and are never reissued, including after a campaign is deleted or support ends.

Owner account and security responsibilities

• The owner must use an email account they are authorised to control and must protect access to that account and to every sign-in link.
• The owner must promptly update or remove a destination that is inaccurate, unsafe, unlawful, compromised, or no longer under the owner’s control.
• The owner is responsible for actions completed through a valid email confirmation or owner session unless the owner has notified us of suspected unauthorised access and we have had a reasonable opportunity to act.
• The owner must not attempt to access another owner’s NFC product, interfere with the service, automate abusive requests, manipulate campaign statistics, or bypass a security control.

Public nature of NFC destinations

An NFC product and its permanent code are designed for public use. Anyone who taps the product, scans or copies its code, or receives its link may be redirected to the selected destination. The owner is solely responsible for choosing what to publish and must not use a destination that unintentionally exposes private, confidential, sensitive, or unlawfully disclosed personal information.

Permitted destinations

The owner controls and is responsible for the destination and all content, products, claims, communications, and activity available through it. An NFC destination must not contain or promote unlawful material, malware, fraud, impersonation, harassment, infringement, dangerous instructions, unauthorised personal information, or content that creates a material risk to users or the service. The owner confirms that they have all rights and permissions required for the destination.

We may review a reported destination and may suspend, disable, or redirect an NFC product where reasonably necessary to protect users, investigate abuse, comply with law or a competent order, respond to a credible rights complaint, or secure the service. We are not required to monitor every destination in advance. Reports of unlawful or rights-infringing destinations may be sent to hi@p-q.es with enough information to identify the NFC code and the concern.

Third-party destinations

External websites, social networks, messaging services, and other third-party destinations are selected by the organiser or NFC owner. A redirect does not mean that pq Solution or PALM N PIXEL S.L. owns, operates, verifies, recommends, or endorses the destination. The third party’s own terms, privacy notice, cookie practices, availability, security, moderation, and account rules apply. The owner and visitor use those services at their own risk.

Support period and renewal

Unless a quotation or campaign agreement states otherwise, digital support is included for one year from the campaign support start date recorded by PALM N PIXEL S.L. After that year, a 30-day renewal grace period applies.

Renewal is not automatic and no payment is taken automatically. A renewal must be requested and confirmed separately. If the service is not renewed during the grace period, the NFC product will stop opening its selected destination and will instead display a “Support expired” message.

Service availability

We aim to keep the service available and secure, but uninterrupted operation cannot be guaranteed. Maintenance, internet failures, hosting incidents, third-party platform changes, legal requirements, or events outside our reasonable control may affect availability. We will take reasonable steps to restore service and protect stored information.

pq Solution does not control external destinations such as social networks, messaging services, or third-party websites and is not responsible for their content, availability, account decisions, or policies.

To the extent permitted by law, the digital service is provided on an “as available” basis. We do not promise that every phone will read every NFC chip, that every third-party destination will accept a link, that anonymous statistics will be complete or free from automated traffic, or that the service will operate without interruption. Campaign reports are operational estimates and must not be treated as audited attendance, identity, sales, or financial records.

Physical product use

The recipient is responsible for using the physical product for its intended ordinary purpose, keeping it away from uses for which it was not designed, and stopping use if it becomes broken or presents an apparent safety risk. Nothing in these terms excludes responsibility for a defective product where liability cannot legally be excluded.

NFC chip changes, rewriting, and tampering

The NFC chip and the information encoded on it may be changed by a person using compatible equipment or software. The owner, recipient, organiser, and any person who handles the product are responsible for any rewriting, erasure, locking, cloning, replacement, redirection, physical alteration, damage, interference, or other modification they perform or authorise. A change may cause the NFC product to stop opening the pq Solution service and may be permanent or impossible for us to reverse.

To the extent permitted by law, pq Solution and PALM N PIXEL S.L. are not responsible for loss, malfunction, redirection, content, access, damage, or other consequences caused by a user or third party changing, erasing, locking, cloning, damaging, replacing, or rewriting an NFC chip or its encoded data, or by using incompatible hardware, software, or instructions.

We can manage only the digital record held within the pq Solution service for an NFC product whose encoded link still points to an official pq Solution domain and a valid permanent code. After verifying the recorded owner, an authorised organiser, or an administrator, we may edit, reset, suspend, or delete the hosted destination or ownership record where the service supports that action. These actions change records in our service; they do not physically write, erase, unlock, repair, or restore an NFC chip. We cannot manage or recover a chip that has been redirected to another service or altered so that it no longer reaches pq Solution.

Liability

Nothing in these terms excludes or limits liability where doing so is prohibited by law, including mandatory consumer rights, data-protection obligations, liability for defective products, fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.

Subject to that mandatory-law exception, PALM N PIXEL S.L. is not responsible for loss, damage, claims, account action, data exposure, or other consequences caused by: a destination or material selected, supplied, approved, or controlled by an organiser or NFC owner; loss of access to the owner’s email or third-party account; a third-party platform, network, device, browser, or service; misuse, unauthorised sharing, or unlawful use of an NFC product; inaccurate organiser instructions; or circumstances outside our reasonable control.

Subject to mandatory law, PALM N PIXEL S.L. is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, anticipated savings, or business interruption. For an organiser acting in the course of a business or profession, our total aggregate liability arising from a campaign will not exceed the amount actually paid to PALM N PIXEL S.L. for the affected campaign during the twelve months before the event giving rise to the claim. This financial cap does not apply where a limitation is prohibited by law.

Events outside reasonable control

We are not responsible, to the extent permitted by law, for delay or failure caused by events outside our reasonable control, including telecommunications or hosting failures, power loss, cyberattacks despite reasonable safeguards, transport disruption, supplier failure, labour disruption, natural events, government action, or changes imposed by a third-party platform. We will take reasonable steps to reduce the effect and resume the affected service.

Ending access

An owner may stop using the service and request deletion of personal information by contacting hi@p-q.es. We may suspend or end access for material breach, unlawful use, security risk, non-renewal, or where required by law. Personal information is handled according to the Privacy Notice.

Law and disputes

These terms are governed by Spanish law. Mandatory consumer protections and jurisdiction rights that apply in a consumer’s country of residence remain unaffected. Please contact hi@p-q.es first so we can try to resolve a concern directly.

Severability and priority

If any part of these terms is invalid or unenforceable, the remaining parts continue to apply to the extent permitted by law. An accepted written quotation or campaign agreement takes priority over these website terms where it expressly addresses the same subject. Mandatory law always takes priority.

Changes

We may update these terms when the service or legal requirements change. The effective date above identifies the version presented at activation.
